partner remortgaging his house and needs both my sons and my signature in order to
get the mortgage approved,? but, I'm not named on his mortgage and i have a mortgage with the same company.I am named as an occupier as we live together,along with my son who is over 18, who also has to sign.I'm now worried that they may look into who is living in my house as i rent it out privately in order to live with my partner,but i don't declare it as i don't make any profit via the rent I'm paid.Where do i stand.
The other thing is im expecting his child in late october,where do i and my child stand in this situation,if i sign this declaration does this mean he can evict me when his child is born

Don't sign it! Sounds to me like his credit isn't good enough to get it re-financed without having a co-signer. And he put *you* at risk by even giving the bank your name as an occupier. If your partner defaults on the mortgage, you and/or your son will be responsible for the debt, plus the debt for your own home. Don't let yourself be used.

I'd be more worried that you could be co-signing the loan. Then you're personally guaranteeing the loan and accepting full responsibility for payment if your partner defaults for any reason. Once you do that, you can't get off that hook until the loan is satisfied. DON'T DO IT.

It sounds as if you and your son are having to sign a consent form for the mortgage to take place.
This is required because you both live in the property and if your partner was to bnot pay the mortgage, you both would have to move out, which is why they need your permissions to grant the remortgage. There is nothing untoward about this, it is completely standard practice. With regards to your mortgage on the property you let out, I wouldnt worry about this. Lenders are notoriously lazy and wouldnt start to cross check your information with their other files. If they did this with every case it would take them a very long time and create masses of extra work. Also there are other people in the world with your date of birth and name so it wouldnt necessarily be accurate. You have nothing to worry about, all the lender will do is put the signed consent forms on the file and tick it off their checklist of things they need to get your partners application through. I hope this helps. (Oh and by the way, lots of people rent out properties without the lender knowing)

You are commiting fraud if your mortgage is residential and you are renting the property but havent told the company you have the mortgage with.
EDIT: Carol B and OP. Just because lots of other people do it, does not make mortgage fraud ok. Carol B, your a mortgage broker - ahh that explains your answer your probably responsible for 'lots of people' committing fraud to take out loan by encouraging them to lie about their income. Your probably hoping it doesnt come back and bite you in the arse too!

Since you and your son occupy your partner's house, it is alright for both of you to sign just to get his remortgage approved. The bank just want to know who are the occupants living in that house. Your own mortgage is another issue.
You are expecting his child he should be happy that you and your new born stay in his house. As I said earlier, your declaration is to help him get his remortgage approved by the bank, he should thank you for your support and help.
