How do I sell a property I co-own abroad?

I was recently bequethed in a will a quarter share of a property in Malta which is divided four ways- two of us want to sell while the other two don't and are generally being obstructive, denying us access to the property while the Maltese solicitors are dragging their feet. Is it possible to get things going by engaging a solicitor in this country or are we stuck with the Maltese legal representatiives?

While I do not have the malta Acts handy, you would handle the matter the same as in the U.S., by filing a Partition Action in the local court.

You would have to hire a local (malta) attorney to file the action and it is expensive, including Duty Taxes on the transfer which you can read here: http://www.business-line.com/tier2/laws/dutyon.pdf

At the minimum, if your share of the property is worth the expense, I would suggest you retain a maltise attorney to protect your asset and consult with that attorney regarding actions to protect your property.
