Can I sue in Small Claims Court for a Real Estate Title issues.?

Can I sue in small claims court over a "marketable title" Issue.
I bought a house and found out the septic is on neighbors land and now they want me to move it. Can I sue the previous owners of the house b/c they did not disclose this to me when I bought the house and they are the ones who put the septic on neighbors property.

Small claims courts are usually limited to small dollar amount claims. Check with your local court system.

This sounds more like civil court to me. You won't recoop very much in small claims and you need to prove that he hid this fact from you. I do not recall seeing anything like this on the disclosure forms.
