Real Estate Purchase?
I have been trying to buy this condo since April 2008 and I just found out that my realtor didn't comply with the financial contingency deadline and never notified the seller's broker that I was going to pursue a different option (FHA instead of Conventional). Now I am requesting my deposit back and since my realtor didn't comply with the deadline the seller is refusing to give me the money back. Can I held my realtor accountable for that money? Can I sue her? I have proof that I sent her an email on the day of the deadline reminding her about it and she told me she sent all the information and I just found out she didn't. What are my options? The property is located in Miami, FL.

We also extended the closing date several times since FHA has not approved the condo yet and it look like they will not approve it. So I decided to get out of the deal and that's when I found out that they can't give me the money back since my realtor never notified them that I was going to pursue another type of financing and never sent them an Addendum specifying that instead of conventional it was going to be FHA.
